Wise: The Guts to carry the TRUTH

As a former member of the U.S. armed services, the Publisher feels the importance of this issue warrants publication of the following commentary.

Many Americans, including most serving military members, are not aware that the very United States Constitution they have sworn to serve and defend and the American rights they maintain and preserve for ALL AMERICANS, do not even apply to them.

There is a secret unconstitutional law that denies military members and their families equal protection and justice under The United States Constitution and The Federal Tort Claims Act (FTCA), 28 U.S.C. 1346 et seq., to seek final redress for wrongful actions taken upon them while serving. These certain actions may include Murder, Reprisal (for reporting Fraud, Waste, and Abuse of taxpayer money), Rape, Human Experimentation, Medical Malpractice, Gross and Criminal Negligence, etc.

The shameful law is called the Feres Doctrine, named after the young Lt. Rudolph Feres, who died in a barracks fire caused by the negligence of the Army. This doctrine bars constitutional redress of wrongful acts or omissions resulting in injury or death arising from non-legitimate military necessity, purpose, or decisions.

The Feres Doctrine law was not created by the United States Congress, who makes laws and oversees the military, but judicially created. This law has been in existence for over 54 years, however Congress and the United States judicial system refuse to address and report respectfully, as this "doctrine" has been so grossly manipulated to be used as a damage control tool to silence and suppress human and constitutional right abuses within the military’s command, legal and medical systems and to conceal blatant criminal acts and obstruction of justice without the call for accountability. Most of the tax paying public is unaware of the extreme human and constitutional abuses being silenced by this law. They are further unaware the Feres doctrine removes "checks and balances" on power in the United States military and allows for the suppression of corruption and criminal activity.

I was recently honored to assist Veterans Equal Rights Protection Advocacy (VERPA, Inc.) in the writing of a United States Supreme Court petition for a Writ of Certiorari concerning a Feres doctrine case wherein a young Marine recruit died of gross medical malpractice. Shockingly, the United States Marine Corp does not dispute the facts that the recruit met his death arising from their acts of negligence, gross negligence and medical malpractice. Moreover, the United States Marine Corp is aware of their criminal acts namely, obstruction of justice, wherein they attempted to conceal their criminal acts leading to the recruit's death, as well as those that occurred after his death.

VERPA, Inc. is the only organization willing to assist and hold the government accountable. It is comprised of true American patriots seeking your support to ensure Military Members and Veterans are afforded equal protection of the United States Constitution. Their Feres Doctrine abolishment initiative seeks to restore constitutional rights to the men and women serving in our military to ensure "gross/criminal" negligent acts or omissions of federal employees arising "incident to service" in the military and leading to unnecessary injury or death of American service members, must be addressed for American national security and for the preservation of good order and discipline in the United States Armed Forces.

Another case I may be allowed to assist VERPA, Inc. with is a family whose son died the day of his promotion prior to the promotion ceremony. The family was invited by the son and had driven to the Army post to attend the ceremony. The United States Army insisted the young soldier committed suicide with inhalants, however the soldier was covered with bruises consistent with a hazing. The statement of an autopsy from the family enraged the Army. Before handing over the body, the Army removed the soldier's heart and brain. It took over two years for the Army to relinquish the heart and brain to the family. How are the actions of the Army supportive of good order and discipline?

Henry Kissenger once stated,- "Military men are just dumb, stupid animals to be used as pawns for foreign policy." (Quoted from The Final Days by Woodward and Berstein). And though this "war tactic" has been used to the fullest, the actions VERPA is trying to EXPOSE includes the battle being fought by our service members within their own ranks.

Our Congress continues to use American military personnel to provide protection of human rights around the world, yet those very military personnel are not afforded the same protection in the United States due to the Feres Doctrine. Please assist me in informing this information to the general public. At the least, I respectfully request that you contact both of your US Senators and Senator Arlen Specter (PA) who is the Chairman of the Senate Judiciary Committee.
