Constitutional Attorneys Response to Health Care Bill

rear_window_blog1Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.

To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.

Why did the president feign ignorance of ACORN when his relationship with the group goes back almost 20 years?

obama_thumb_01September 24, 2009 – Given President Obama’s long and close ties to ACORN, it is understandable that he should have distanced himself as long as possible from the latest and most heinous ACORN scandal: the capture on video of employees in at least five different ACORN offices avidly coaching activists, posing as a pimp and prostitute, in how to set up child-prostitution brothels and commit housing fraud. In the latest of these undercover videos, one staffer went so far as to offer to assist in smuggling a dozen underage girls into the U.S. as sex slaves.

But this past weekend, when asked during an ABC interview about the videos, President Obama had no choice but to respond. What the videos reveal, he said, “was certainly inappropriate and deserves to be investigated.”

Are Our Founders Rolling In Their Graves?

ross_jeff_thumbThe other day, just as I sat down to lunch, one of my co-workers, who was sitting at the table, blurted out, “Boy, I bet the founding fathers are rolling in their graves.” I was tempted to play devil’s advocate, and ask him what made him say that, but I thought better of it. However, his comment stuck with me throughout the remainder of the day. I kept thinking of the many reasons that would cause our founders to roll in their graves.

One reason might be due to the policy of the person who currently occupies the Oval Office. Or possibly it could be due to the fact that our government isn’t quite what they envisioned when they drafted the Constitution.

Surprise!  It’s not exactly going your way, is it?  You thought that because a whole bunch of dependent Americans, that your party has bought off for the last 100 years with our money, who have their hand out to government for everything they can get, that voted for your illusive hope and change, that you could have your way with the rest of the country, didn’t you?  How’s that working out for you Mr. President?  Your poll numbers are dropping like a rock.

Your in-experience is getting more visible by the day.  Connections to your corrupt, community organizing past and present are being relentlessly exposed.  Radical communists and socialists that infect your cabinet, czars and advisors are a window to your evil agenda.

Baldwin: It is Going to Be a Rocky Road

Few remember the dangers and hardships of World War II; fewer still remember the Great Depression. Few Americans know what it’s like to not have some sort of “supercenter” nearby with shelves stocked with every kind of food imaginable, twenty-four hours a day. Few know what life was like before there were restaurants of all sizes and types on virtually every street corner in America. And only a handful remembers when most roads were unpaved, or when sports were truly a pastime and not a megabuck obsession.

Modern living within the world’s only “superpower” has created a giant unsuspecting, soft, lackadaisical, and lethargic society.

point_blank_blogWhen World War Two arrived at America’s doorstep, we had to virtually build an Army, Air Force, Navy and Marines from scratch. The war had been raging in Europe since 1939 by the time the Japanese attack on Pearl Harbor propelled us into war in 1941. The Japanese had been sacking, raping and looting Manchuria and China since 1931.

Now President Obama wants to reduce the U.S. arsenal of nuclear weapons to a reported “hundreds rather than thousands” to prepare for deep cuts. Truman was the first and last president to actually use a nuclear weapon to end the war with Japan.

Since then, all presidents have paid lip service to reducing the threat of nuclear weapons, but there is an iron law that says you cannot “un-invent” something once it comes into existence.

Obama’s Nontax – uh – Tax

obama_thumb_01On a Sunday show (9/20/09), the President offers a revealing definition.

President Obama didn’t make much news on his round of five Sunday talk shows yesterday, with one notable exception. The President revealed a great deal about his philosophy of government and how he defines a tax increase. It turns out the President thinks a health-care tax is not a tax if he thinks the tax is for your own good.

Appearing on ABC’s “This Week,” Mr. Obama was asked by host George Stephanopoulos about the “individual mandate.” Under Max Baucus’s Senate bill that Mr. Obama supports, everyone would be required to buy health insurance or else pay a penalty as high as $3,800 a year. Mr. Stephanopoulos posed the obvious question about this kind of coercion when “the government is forcing people to spend money, fining you if you don’t [buy insurance]. . . . How is that not a tax?”

Return from the Abyss

bennett_blog_2I have been away for a few days, and upon my return late last night, I found that not much had changed and the world continued to turn – or spin out of control on its axis of evil. The following has transpired (and probably much more)::

  • The Obamameister has suggested that a bailout of the newspaper industry might be under consideration.

Is he out of his ever lovin’ mind? Newspapers don’t make money by selling thinly disguises bird-cage liners. They make money by selling advertising. It’s why I don’t buy them. I can look in the yellow-pages, if I want advertising. I want to read NEWS! But that won’t happen here in America – unless you go to some independent sources – and they are all on-line. That’s why the published word is dying – and it should be buried!

The only reason that Oboingo is considering bailing out the newspaper industry, is because most of them publish his words and deeds as they are instructed to do  – and they do it ever so blindly. Which is to say that, they are his shills. “Yaw baby! Don’t question de Massah, or you might be labeled as ‘racist’!”

A small handful of wealthy internationalists and socialists own these rags, and they are a B-I-G part of what is wrong in this nation. I’ll not quote Swinton here today, as I have done so elsewhere, and everyone knows the story. If you don’t, then do a  Google search for John Swinton – and you’ll better understand.

  • The EMERGENCY Hell-Care bill is still being bandied about – you know – the one that absolutely, positively HAD to be passed right then and there or the country would collapse.

That fight continues and THEY are hoping that we’ll go back to sleep. Ain’t gonna happen. The Federal Observer is ready to get back to work on this issue. I have enough family members to care for – I can’t afford to care for someone elses. OH – that’s right – it wasn’t healthcare anyway – it was Government takeover and control of the Insurance industry. HR 3200 & HR 3400 in the House and over in the Senate, they now have the Baucus Bill – another scam we’ll have to watch. The U.S. CONgress has had 16 years since Billy Jeff took HellareeCare to the same august body to get REAL reform right. They didn’t do it then, they can’t do it now, nor will they ever be able to.  Leave it to the government to screw up a wet-dream! Don’t believe me? In the words of Bette Davis’ character, Margo Channing  in 1950′s  All About Eve, “Stick around! It’s going to be a bumpy night!”

The 19′s
If I were a numerologist, I would be nodding my head along about now. April 19th of course has it’s own series of interconnected happenings, Lexington & Concord, (Mt. Carmel) Waco, the Oklahoma City Bombing – and I am sure a few other things.

Upon my return from the serenity of the fresh, green mountains of Arizona late last night, I heard of the passing of one of the last remaining independent publishers in America, Don Harkins of the Idaho Observer. This morning, I learned that author and commentator, Fred Marshall Jr. had also passed on the same day. Do a Google search on wither or both of these names and see what you can find. Both passed away on September 19, 2009.

Last night, I posted the following on Don’s memorial webpage, and when I wrote my sentiments, Fred was in the back of my mind, as I knew that his time was nearing an end.

I am truly saddened by this loss.

When the Federal  Observer first went on line on July 22, 2001, Don was among the first to congratulate me and wish us well. His note was brief, but memorable, as he said, “Good choice of a name.”

There are far too many of us becoming deathly ill, and I fear that our strongest messengers are being silenced.

Don can not be replaced, but his passing, sounds a trumpet (Gabriel’s, I suspect) that those of us who remain, must carry the torch in his name.

May it burn ever-so brightly, as we march toward victory.

God gave us the rope. We hung ourselves. It’s time to roll up our sleeves and get back to work, and that’s what I’ll be doing tonight and tomorrow – and as long as there is something worth fighting for.

Mary Travers: A Fighter ’til the end

Mary Travers, whose ringing, earnest vocals with the folk trio Peter, Paul and Mary made songs like “Blowin’ in the Wind,” “If I Had a Hammer” and “Where Have All the Flowers Gone?” enduring anthems of the 1960s protest movement, died on Wednesday at Danbury Hospital in Connecticut. She was 72 and lived in Redding, Conn.

The cause was complications from chemotherapy associated with a bone-marrow transplant she had several years ago after developing leukemia, said Heather Lylis, a spokeswoman.

Ewart: Constitution Day – What Constitution?

postman_ewartThe ink was barely dry on the constitution when efforts began to change it.  Not all were in agreement with its original content and thought it could be improved.  Alexander Hamilton wanted more power in the central government.  Most others wanted the lions share of the power to rest with the states and the people.

Judicial tests of the constitution started almost immediately.  In 1801 a celebrated case was brought to the U. S. Supreme Court in Maybury vs. Madison and was the first time the Supreme Court declared something unconstitutional.  The court established the concept of judicial review in the U.S. (the idea that courts may oversee and nullify the actions of another branch of government).

There Appears To Be A Misunderstanding

ross_jeff_thumbMy last two commentaries sure stirred up quite a ruckus. Those who responded unfavorably to what I said seem think that I am putting forth the call for all freedom loving Americans to take up arms against anyone we disagree with.

One of these individuals put forth a lot of effort to write a commentary about what I had said. He believed that there must be a plan, and we must have leaders who can outline the plan. He believed that our best course is to unite all true conservatives together under common leadership that will speak for the masses.

Another individual said that I am willing to take up arms over my personal disagreement over policy issues and that I should work within the system while a peaceful alternative remains available.
